Either way, that Punisher deal pushed the HFA through and all the muties underground. That was 10 years ago."

State: Mutants have been pushed underground in the U.S. and abroad (most Western countries) and scattered after the passing of the Humanity First Act--a law effectively stripping most legal rights from those with the X-Gene. Those that can blend in do their best to hide their powers or risked being picked up by the Department of Health and Human Protection (aka HHP or Paragons). Some small communities of mutants do exist: Morlocks and Runaways in NYC, Xavier's remnant somewhere in the Northeast U.S., and the Maple Leaf Legion in Toronto to name a few.
The X-Men do exist though in multiple capacities. There is a team of X-Men, usually just called "X", that reside with and protect Xavier's remnant. The other team that the public refers to as the "X-Men" are a team of mutants that are government sanctioned heroes. These X-Men were started after one of X's first missions where they stopped their foe in the middle of Times Square. One of them--Alison Blaire aka Dazzler--did an interview with CNN not long after and left Xavier's to create a government-sponsored, public X-Men unit. Over time though they became the only X-Men the world knew or cared about. After the HFA passed they became less active for crime fighting and more active as celebrities garnering book/movie/record deals, sponsorships, the whole 9 yards.
